Expert Witness

Whether you are an insurer, barrister, solicitor or accountant, Mark Lee FCA CTA (Fellow) can advise and act on your behalf or on the direction of the Court.

In cases of professional negligence and disputes involving accountants and tax advisers you may require Mark’s opinion on the standard of care that can reasonably be expected, as well as advice on causation and quantum.

Mark can assist at any stage of the dispute, advising on the merits of the case as regards liability, quantifying the loss and if required, providing an expert witness report.

How can Mark Lee help you

Mark will normally look beyond the instructions he receives and ensure that all relevant issues are identified. With the approval of those instructing him he will then address all key matters in either an informal or full CPR compliant report as required.

The areas where Mark can assist include:

  • Partnership disputes;
  • Shareholder and director disputes;
  • Professional negligence (despite the contradiction in terms!);
  • Matrimonial disputes;

Why appoint Mark Lee as your expert?

Mark is trained and experienced in writing clear, reasoned and persuasive reports and in providing expert evidence to the court.

Mark has 'been in the box' and has been cross examined as recently as 2006. He has yet to have a judge reject his expert evidence.

Mark's career includes a number of roles that also make him an eminently credible expert witness in tax related professional negligence claims.

  • Elected chairman of the ICAEW Tax Faculty from 2003-2005;
  • Tax partner in the London offices of both BDO Stoy Hayward and Horwath Clark Whitehill;
  • Director responsible for the tax support for professionals team at Chiltern plc;
  • Appointed a Fellow of the Chartered Institute of Taxation in 2005.

Notwithstanding his senior tax appointments Mark is no technical 'geek'. He is articulate and well acquainted with the pressures and issues facing smaller practitioners. He has for many years been a frequent and popular speaker at conferences and seminars for accountants; he invariably spends much time discussing relevant issues with them one on one.
